California Restaurant Insurance
The ultimate guide to fortifying your gastronomic ambition!
Restaurant insurance for California owners
California has more restaurants per capita than almost any state in the country. Workers compensation rates here are among the highest in the nation, the plaintiff bar is aggressive, and the regulatory burden adds costs that most other states simply don’t have. Running a restaurant here is genuinely difficult. Getting the wrong insurance, or not enough of it, makes it worse.
Farmer Brown Insurance has been placing restaurant insurance for California owners since 1996. We work with A-rated carriers and get certificates issued the same day in most cases.

General liability insurance for California restaurants
If a customer slips on a wet floor, gets sick from something they ate, or claims your staff damaged their property, general liability covers the medical bills, legal fees, and any settlement. It is the first policy any California restaurant needs. Most commercial landlords require proof of it before handing over the keys, and many local business licensing applications require it as well.
A serious slip and fall in California can generate a lawsuit well above $100,000. A foodborne illness claim involving multiple customers can exceed that significantly. Without general liability, those costs come directly out of the business.
California restaurants typically carry $1,000,000 per occurrence and $2,000,000 aggregate. Restaurants with high foot traffic, delivery operations, or alcohol service often need higher limits or a commercial umbrella to reach the total a contract or landlord requires.

Workers compensation for California restaurants
California requires workers compensation for every employer with at least one employee. There are no exceptions for restaurants. Operating without it can result in criminal charges and fines starting at $10,000. The state enforces this aggressively.
Restaurant work generates frequent claims. Burns from kitchen equipment, cuts from prep work, slips on wet floors, and repetitive strain injuries from long shifts. Workers compensation covers medical expenses, rehabilitation costs, and a portion of lost wages when an employee is injured or becomes ill because of their job. It also provides death benefits to families after fatal work-related incidents.
For a restaurant with $500,000 in annual payroll, workers comp in California typically runs between $15,000 and $30,000 per year depending on job classifications and claims history. Kitchen workers are rated higher than front-of-house staff. A clean safety record reduces the experience modification factor and lowers the premium over time.

Property insurance for California restaurants
Property insurance covers the physical assets of the restaurant against fire, theft, vandalism, and certain natural disasters. Two perils deserve specific attention for California restaurants.
Main Components of Property Coverage for Restaurants:
Wildfires
California has had more major wildfire events in the past decade than in any comparable period in state history. Standard property policies cover fire damage. If your restaurant is in or near a high-risk zone, confirm that your policy does not carry wildfire exclusions or sublimits before you sign it.
Equipment breakdown
A walk-in cooler that fails overnight, a commercial oven that stops mid-service, a POS system that crashes during a busy Saturday. Equipment breakdown coverage pays for the repair or replacement and in some cases covers spoiled inventory. It is not included in a standard property policy and needs to be added as an endorsement.
Property insurance covers the building if you own it, the leasehold improvements if you lease, and all business personal property including kitchen equipment, furniture, fixtures, and inventory.

Commercial auto insurance for restaurants in California
Commercial Auto Insurance has grown increasingly important for California restaurants, especially with the rise of food delivery services. As a restaurant owner, you must be aware of the potential liabilities your company-owned vehicles might face while on the road. This is where Commercial Auto Insurance steps in, providing coverage for accidents involving your business vehicles and protecting your restaurant from financial loss.
Financial protection
Commercial Auto Insurance safeguards your restaurant’s finances, preventing substantial out-of-pocket expenses for vehicle repairs, medical costs, and potential lawsuits following an accident.
Road risk mitigation
Commercial Auto Insurance helps cover accident-related costs for your frequently-traveling delivery vehicles, protecting your business from the repercussions of road accidents.
Regulatory compliance
By California laws, Commercial Auto Insurance ensures that your business remains compliant when using vehicles for delivery or other business-related purposes.
Employee safety assurance
Commercial Auto Insurance underscores your commitment to driver safety, covering their medical expenses in case of an accident and providing them peace of mind.

Liquor liability insurance for California restaurants
California does not have a broad dram shop statute that holds restaurants automatically liable for the actions of intoxicated customers. But that does not mean you are protected. Liability can still arise under negligence theory. If your staff over-serves a visibly intoxicated patron who then injures someone, California courts have found restaurants liable for those damages.
Liquor liability covers claims arising from alcohol service, including legal fees, medical costs, and property damage tied to harm caused by an intoxicated customer after leaving your establishment. It is separate from general liability. If you serve alcohol and do not carry it, you have a gap.
What drives the price in California:
| Factor | Explanation |
| Percentage of revenue from alcohol | A restaurant where alcohol is 40% of revenue costs more to insure than one where it is 10%. Bars and late-night operations pay more than lunch-focused restaurants. |
| Hours of operation | Later closing times and weekend-heavy schedules raise premiums. |
| Staff training | Carriers discount policies where staff holds responsible beverage service certification. California’s RBS certification program, which became mandatory in 2022, counts toward this |
| Location | Los Angeles and San Francisco carry higher rates than suburban or rural markets. |

Business Owner's Policy for California restaurants
A Business Owner’s Policy, or BOP, combines general liability and commercial property coverage into a single policy at a lower total cost than buying each separately. Most BOPs also include business interruption coverage, which replaces lost income if a covered event forces the restaurant to close temporarily.
For California restaurants, that last piece matters. A kitchen fire that takes three weeks to repair, a water main break that shuts down the block, a wildfire evacuation order. Business interruption coverage pays the bills while the doors are closed.
A BOP is a practical starting point for most independent restaurants. It does not replace workers compensation, liquor liability, or commercial auto. Those require separate policies.

Commercial auto for California restaurants
If your restaurant uses any vehicle for business purposes, personal auto insurance will not cover an accident that happens on a delivery run. California courts have established this and personal auto carriers routinely deny claims involving business use.
Commercial auto covers vehicles owned by the restaurant, employees who drive those vehicles, and in most policies, employees who use their personal vehicles for delivery. If you run your own delivery operation with your own staff, this coverage is not optional.
